SPOUSAL SUPPORT

Can be waived by one or both spouses

If waived by only one spouse, it stays in and is ordered in the case

It’s based on the income of both spouses and standard of living during the marriage

It’s usually ordered by the Court to be paid for half the time of the marriage for marriages between 5+ and 10 years in length

Can be indefinite in marriages over 20 years

Can be voided if recipient remarries or cohabits over specified time period
